BACKGROUND
The purpose of this Transmittal Notice (TN) is to forward a copy of the revised Delegation of Authority (DOA), Administrative #27, "Response to Subpoenas and Requests for Documents or Testimony (Other than Expert Testimony)." This DOA is being reissued to remain consistent with the Departmental regulations found at 45 Code of Federal Regulations Part 2 (the Touhy Regulations) and the Indian Law Enforcement Reform Act, as amended by the Tribal Law and Order Act of 2010, Pub. L. 111-211, codified at 25 United States Code § 2801 et seq., where the Agency supports and encourages employee testimony in both civil and criminal cases.

MANUAL MAINTENANCE
Remove and discard the current copies of DOA, Administrative #27, "Testimony in Private Litigation," dated August 1, 1990, August 7, 1990, and August 11, 1990, from your manual system binders. Insert the attached copy of the revised DOA, Administrative #27, "Response to Subpoenas and Requests for Documents or Testimony (Other than Expert Testimony)," TN 2013-08, in its place.
