BACKGROUND:
The purpose of this Transmittal Notice is to forward a copy of the revised Delegation of Authority (DOA), ?Health Maintenance Organization Act of 1973, (Public Law 93-222).? This DOA delegates the authority under 42 United States Code, Section 2001(b), to the Deputy Director, Indian Health Service (IHS), and the Deputy Director for Management Operations; Area Directors; Area Deputy Directors; Chief Executive Officers; the Director, Office of Resource Access and Partnerships; and the Director Division of Contract Care, with the consent of the Indian people served, to contract with private or other non-Federal health agencies or organizations for the provisions of health services to such people on a fee-for-service basis or on a prepayment or other similar basis.

Remove and discard the current copies of Program #3 DOA, dated November 23,1988 (Manual Exhibit 1-5.1H, dated June 26, 1989, TN 89.3) from your manual system binders. Insert the attached copy of the revised DOA, Program #3, TN 2006-05 in its place.
Log and file this Transmittal Notice in sequential order.
