Transmittal Notice 97-01

BACKGROUND
This is to transmit revisions to the Indian Health Manual (IHM) Part 2, Chapter 3, "Contract Health Services (CHS)." These revisions address changes to how appeals of CHS denials issued by health programs operated under Title I or Title III of Public Law (P.L.) 93-638, the Indian Self-Determination and Education Assistance Act, as amended, are to be handled by the IHS and tribes and tribal organizations. This revision is based on a legal opinion by the Office of the General Counsel that states that the IHS CHS program appeals procedures do not apply to tribally administered CHS programs, unless agreed to by the tribes and incorporated into Title I and Title III agreements.

Log and file this TN 97-01 in sequential order.
