BACKGROUND:
The purpose of this Transmittal Notice (TN) is to forward a copy of the Part 2, Chapter 7, "Health Insurance Portability and Accountability Act Privacy Rule" Indian Health Manual (IHM). The purpose of this chapter is to publish the Indian Health Service (IHS policy and procedures regarding the Health Insurance Portability and Accounting Act (HIPAA) Privacy Rule and the Privacy Act requirements. It also provides instructions and guidance regarding the HIPAA Privacy Rule and the Privacy Act requirements; the IHS Notice of Privacy Practices or "Notice," the use of standardized compliance forms and instructions for sending and receiving confidential information by facsimile.

MATERIAL TRANSMITTED:
The new IHM, 2-7, including the chapter Table of Contents, and Manual Exhibits 2-7-A through 2-7-T.
MATERIAL SUPERSEDED:
This chapter supersedes the IHS Circular No. 2003-02, "Health Insurance Portability and Accountability Act Privacy Rule Implementation Guidelines," dated April 14, 2003.
MANUAL MAINTENANCE:
Remove and discard the current copies of the IHS Circular No. 2003-02, "Health Insurance Portability and Accountability Act Privacy Rule Implementation Guidelines," dated April 14, 2003, from your manual system binders.
Insert the attached copy of the new IHM, 2-7, including the chapter Table of Contents, and Manual Exhibits 2-7-A through 2-7-T, in the manual system binder in Part 2 after chapter 6.
Log and file this TN in sequential order.
